Well the way the rules work, it doesn't matter if someone knows you're there. Once you start initiative, if you haven't acted in the initiative order yet, you are flat-footed. Again, this is because even though you may be ready to act, you're still going to be caught off guard if people are faster than you, acting before you expect it. There are also other ways to describe why people would be flat-footed in combat, even if they were prepared for a fight. But again, according to the rules, even if you're ready for combat, if you haven't acted yet in the initiative order, you are flat-footed. Have fun and good gaming!
